Hi Anto
with that caliper in the way I think the stay will have to be mounted inboard as you have it now. The stays are slightly malleable but I think putting a tight bend in to clear the caliper will be too much and probably break quickly.

For neatness you could use some short hexagon head bolts screwed in from the inside, instead of the long bolt screwed through from the outside with a nut on the end as you have now.

Doing both stays like that would give a nicely triangulated mount.

'twas easier to fit on a Sherpa with V brakes for sure!
Happy fiddlin'

Anto,
It is for sure the particular brake you are using, as I have fitted racks to both my 853s including the one you now have.
Try:- http://www.sjscycles.co.uk/tubus-roundstay-l-bent-190-mm-black-prod21529/
or bend and shape yoursef.
Both sides should be done the same. The easier way is to bolt both struts inside as you have (one) at present.

THanks Lads, yeah i think i'll settle for  mounting on the inside i'm certainly not buying new brakes.
it seems solid enough anyhow.
the problem i think is theres not enough of a bend in the brake caliper arm. ::)

anyway no big deal the new bike is lovely well pleased.
john i must get the history of this bike from you thanks.
